b) These Terms are published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, requiring publication of rules, regulations, privacy policy, and Terms of Use for access or use of https://www.creditcares.in.

c) The domain https://www.creditcares.in (“Website”) is owned and operated by CreditCares, a loan agency based in Kolkata, West Bengal.

d) For the purpose of these Terms:

• “User” / “You” refers to any person or entity accessing or using the Website and its services, competent to enter into legally binding contracts under the Indian Contract Act, 1872.

• “We” / “Us” / “Our” refers to CreditCares.

• “Parties” refers collectively to the User and CreditCares.

2. Our Services

CreditCares operates as a loan facilitator (DSA) with partnerships across multiple banks and NBFCs.

Our services include:

• Construction Finance

• Project Loan

• Commercial Purchase

We assist users with eligibility assessment, documentation coordination, and liaison with financial institutions.

CreditCares does not provide loans directly. All loans are sanctioned, processed, and disbursed solely by partner banks or NBFCs.

3. Eligibility

By using the Website, you confirm that you:

• Are at least 18 years of age

• Are legally capable of entering into contracts

• Are using the Website for lawful and genuine financial purposes

• Will not use the Website for fraud, impersonation, or illegal activities

4. Lead Sharing and Data Use

By submitting information on the Website or contacting CreditCares, you authorize us to:

• Share relevant information with partner banks, NBFCs, or financial institutions

• Contact you via call, SMS, WhatsApp, or email for verification and processing

5. Payment Terms and Client Advisory

a) CreditCares does not charge any upfront consultancy or processing fees from clients.

b) CreditCares earns service fees or commissions only after successful loan disbursement by partner banks or NBFCs.

c) No employee, agent, associate, or representative of CreditCares is authorized to:

• Collect cash or personal payments

• Ask for money in personal bank accounts, UPI IDs, or wallets

• Offer guaranteed approvals or special benefits in exchange for payment

d) Any payment request made outside official communication channels is unauthorized. CreditCares shall not be responsible for losses arising from such transactions.

e) Users must report any suspicious payment request immediately to info@creditcares.in.

6. User Obligations

Users agree to:

• Provide accurate and truthful information

• Avoid submitting false, misleading, or forged documents

• Refrain from misusing the Website or services

• Avoid activities that disrupt Website security or operations

Violation may result in suspension or termination of access.

7. Communication Consent

By providing contact details, you consent to receive communications from CreditCares through:

• Phone calls (manual or automated)

• SMS and WhatsApp

• Emails

8. Employee Conduct and Misuse Disclaimer

• Making false claims or guarantees

• Misusing client data or company property

9. Disclaimer of Guarantee

CreditCares does not guarantee:

• Loan approval

• Interest rates

• Loan tenure

• Disbursement timelines

All final decisions rest with partner banks and NBFCs.

10. Intellectual Property

All Website content, including text, design, graphics, logos, and branding, is the exclusive property of CreditCares.

• Loan rejection or delay by banks or NBFCs

Any liability, if applicable, shall not exceed the amount paid (if any) to CreditCares.

12. Termination of Access

CreditCares may suspend or terminate access if:

13. Governing Law and Jurisdiction

These Terms are governed by the laws of India.
Courts located in Kolkata, West Bengal shall have exclusive jurisdiction.
