1. General

a) This document is an electronic record under the Information Technology Act, 2000 and applicable rules. It is generated by a computer system and does not require physical or digital signature.

b) These Terms are published in accordance with Rule 3(1) of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, requiring publication of rules, regulations, privacy policy, and Terms of Use for access to https://www.creditcares.in.

c) The domain https://www.creditcares.in (“Website”) is owned and operated by Creditcares, a loan agency headquartered at:
56L Bidhannagar Road, Ultadanga, Kolkata, West Bengal 700067, India.

d) For the purpose of these Terms:

  • “User” / “You” means any person or entity accessing or using the Website and legally capable of entering contracts under the Indian Contract Act, 1872.

  • “We” / “Us” / “Our” refers to Creditcares.

  • “Parties” refers collectively to the User and Creditcares.

e) By using the Website, you agree to these Terms and the Privacy Policy. If you do not agree, discontinue use immediately.

f) Creditcares may revise these Terms at any time. Updated versions will appear on the Website. Continued use means acceptance of changes.

2. Our Services

Creditcares operates as a loan facilitator/DSA working with multiple banks and NBFCs.

Services include:
Loan Against Property / Mortgage Loan, Business Loan, Cash Credit, Overdraft, Home Loan, Machinery Loan, Construction Finance, Project Loan, Commercial Purchase, Balance Transfer.

We assist with eligibility assessment, documentation support, and coordination with lenders.

Creditcares does not provide loans directly. Loan approval, sanction, and disbursement are solely decided by partner banks or NBFCs.

3. Eligibility

By using the Website, you confirm that you:

  • Are at least 18 years old

  • Are legally competent to contract

  • Use the Website for lawful financial purposes

  • Will not use the Website for fraud, impersonation, or illegal activity

4. Lead Sharing and Data Use

By submitting information on the Website or contacting Creditcares, you authorize us to:

  • Share relevant details with partner banks, NBFCs, or financial institutions

  • Contact you through phone, SMS, WhatsApp, or email for processing and verification

All personal and financial data is handled in line with the Privacy Policy.

5. Payment Terms and Client Advisory

a) Creditcares does not normally charge upfront consultancy or processing fees unless clearly stated in writing.

b) Creditcares earns service fees or commissions primarily from partner lenders after successful disbursement.

c) No employee, agent, or associate is authorized to:

  • Collect cash payments

  • Request payment in personal accounts, UPI IDs, or wallets

  • Offer guaranteed approval or special benefits for money

d) Any payment request outside official company communication is unauthorized. Creditcares is not responsible for losses from such transactions.

e) Suspicious payment requests should be reported to info@creditcares.in immediately.

6. User Obligations

Users agree to:

  • Provide accurate information

  • Avoid submitting forged or misleading documents

  • Not misuse Website systems or services

  • Not attempt to disrupt security or operations

Violation may lead to suspension or termination.

7. Communication Consent

By sharing contact details, you consent to receive communication through:

  • Phone calls

  • SMS or WhatsApp

  • Email

You may opt out of promotional messages by emailing info@creditcares.in. Case-related communication may still continue.

8. Employee Conduct and Misuse Disclaimer

Employees, DSAs, associates, and partners are strictly prohibited from:

  • Misusing the Creditcares brand or authority

  • Collecting personal payments

  • Making false promises or guarantees

  • Misusing client data or company systems

  • Engaging in fraud, bribery, theft, or misrepresentation

Such actions are personal misconduct and do not represent Creditcares. Legal action may be taken where required.

9. Disclaimer of Guarantee

Creditcares does not guarantee:

  • Loan approval

  • Interest rate offered

  • Loan tenure

  • Processing or disbursement timelines

All final decisions are taken by banks or NBFCs.

Website information is for general guidance and may change without notice.

10. Intellectual Property

All Website content including text, graphics, logos, design, and branding belongs exclusively to Creditcares.

Unauthorized copying, reproduction, or distribution without written permission is prohibited.

11. Limitation of Liability

Creditcares shall not be liable for:

  • Loan rejection or delay by lenders

  • Unauthorized acts of individuals claiming association

  • Losses from unofficial communication or payments

  • Website downtime or technical failures

  • Third-party service issues

Any liability, if applicable, shall not exceed the amount paid directly to Creditcares (if any).

12. Termination of Access

Creditcares may suspend or terminate access if:

  • False information is submitted

  • These Terms are violated

  • User activity harms company operations or reputation

13. Governing Law and Jurisdiction

These Terms are governed by the laws of India.
Courts located in Kolkata, West Bengal shall have exclusive jurisdiction.
